A cease and desist letter is a very specific type of letter that is written by an attorney on behalf of a consumer to a debt collector. The federal Fair Debt Collection Practices Act governs the ways that bill collectors can communicate with consumers.
It states how, when, and what bill collectors can talk and can communicate with consumers. It also states all the ways that bill collectors cannot communicate with consumers. It states that once a consumer notifies a bill collector that they’re represented by an attorney, that bill collector can no longer contact the consumer and can only communicate through the attorney. If that bill collector does not comply, the law provides a hefty fine for those bill collectors, and it provides for attorney’s fees.
