What is a Notice of Representation?
A Notice of Representation is a specific type of letter written to a debt collector by an attorney, on behalf of a consumer. According to the federal Fair Debt Collection Practices Act, once a debt collector is notified in writing that a consumer is represented by an attorney, that debt collector can no longer contact the consumer directly in any way. By law, they must communicate through the attorney only. If the debt collector does not comply with this law, the company can be required to pay damages to the consumer and their attorney’s fees.
